Many people can be put off approaching a compensation solicitor because they are worried about the costs they may incur.


There is a great deal of suspicion surrounding compensation claims. This is largely because of the activities of a few rogue companies who have marketing heavily to target markets and who then take a large percentage of the award as their fee.

Most people understand that legal proceedings cost money. There is the compensation solicitor’s time to be paid for, along with any costs for additional medical reports, expert witnesses and fact-finding programmes. If you lose your case, you may also be liable for the other party’s costs.

In many cases, these costs can be minimised or cancelled altogether. If you win your case, the losing party will usually be required to pay your costs, which means that all your fees are paid without having to eat into your compensation award.

Many solicitors work on a “no win, no fee” basis. This means that if you lose the case, you will not be liable for the monies owed to your solicitor or any other professionals involved with your case. This works because the solicitors take out an after-the-event insurance policy on your behalf. This policy covers all your costs, plus the third party’s costs if you lose, and the costs of the insurance policy itself. This means that you can be assured that if you win your case, your fees will be paid by the losing party and if you lose, your costs will be paid by the insurance company.
